Defense lawyers representing Molly Katanga, the jailed widow of Kampala businessman Henry Katanga, have accused the Police’s Director of Forensic Services, Andrew Mubiru Kizimula, of examining a different gun than the one submitted by police investigators.
During further cross-examination of Kizimula, who is also the prosecution’s eighth witness, it has been established that the serial number of the supposed killer pistol submitted by the police for DNA analysis is different from the serial number contained in Mubiru’s DNA report presented to the court.
The lawyers, led by Macdusman Kabega, are now suggesting that to incriminate the widow, Mubiru, a DNA expert, examined a gun from a different murder case and included his findings in the Katanga murder file.
To support their assertion, Kabega has instructed Mubiru to read out a Court of Appeal judgment in which the justices observed that Mubiru had examined a blood-stained ten-liter jerrycan that was not part of the exhibits submitted by investigators in the ritual sacrifice case against Masaka businessman Kato Kajubi.
Mubiru was further questioned about his decision to ignore testing several sticks (Enkoni and a baton) for DNA, under the pretense that he did not see any physical stains on them, even though they were assault objects recovered from the scene.
The lawyers now accuse Mubiru of failing to analyze the said sticks because they would reveal that they contained Molly Katanga’s DNA, confirming that she had been battered on the fateful day of November 2, 2023.
However, Mubiru has denied all the accusations from Katanga’s lawyers.
This marks Mubiru’s seventh appearance on the witness stand since his first testimony on August 27, 2024.
Trial Judge Isaac Muwata has adjourned further case hearings to October 1, 2024.
